1. Introduction

Fennie ('we,' 'our,' or 'us') is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our AI-powered academic tutoring platform. By using our service, you consent to the data practices described in this policy.

IMPORTANT: We do not sell your Personally Identifiable Information to third parties, with one narrow exception that is always under your control: our opt-in Educational Discovery program (described in Section 5). If you ask us to connect you with an educational institution — or opt in to being discovered by institutions that match your academic or career interests — we will share the contact and interest information you provided with those institutions, and we may receive compensation for the introduction. We never share your contact information with any institution unless you have affirmatively opted in. Outside of that opt-in program, your Personally Identifiable Information is used solely to provide and improve our services. Anonymized Data (as defined below) is not subject to these restrictions.

2. Definitions

Personally Identifiable Information ("PII")

PII is any information that can be used, alone or in combination with other information, to identify, contact, or locate a specific individual. This includes but is not limited to:

  • Name, email address, and contact information
  • Account credentials and authentication tokens
  • Payment and billing information
  • IP address (when linked to an identifiable user)
  • Device identifiers tied to a specific user account
  • Any content you create that contains personally identifiable details

Anonymized Data

Anonymized Data is information that has been processed to remove, replace, or obscure all personally identifiable elements such that the data cannot reasonably be used to identify any individual, either on its own or in combination with other data. This includes aggregated statistics, de-identified usage patterns, anonymized learning analytics, and any other data from which all PII has been irreversibly stripped. Anonymized Data is not considered personal data and is not subject to the restrictions in this Privacy Policy that apply to PII.

3. Information We Collect

Account Information

  • Email address (required for account creation)
  • Email address and self-declared age you submit through the optional Educational Discovery signup (Section 5), used for that program and — unless you unsubscribe — occasional study tips and Fennie product updates
  • Name (if provided)
  • Profile information and preferences
  • Authentication data from third-party providers (Google, etc.)
  • Subscription and payment information (processed securely by Stripe)
  • Account status and usage history

Content Data

  • Notes, documents, and study materials you create
  • Chat conversations with our AI tutoring system
  • Shared content and sharing preferences
  • Search queries and interactions
  • Generated quizzes, flashcards, and study materials
  • Theme preferences (dark/light mode)

Usage Information

  • Device information (browser, operating system, device type)
  • IP address and approximate location data
  • Usage patterns, feature interactions, and session data
  • Performance metrics, error logs, and crash reports
  • Referral sources and marketing attribution data
  • User behavior analytics for service improvement

Technical Data

  • Cookies and similar tracking technologies
  • Server logs and system performance data
  • Security and fraud prevention data
  • API usage and rate limiting information

4. How We Use Your Information

Use of Personally Identifiable Information

We use your PII only for the following purposes:

  • Provide and maintain our AI tutoring and note-taking services
  • Personalize your learning experience and recommendations
  • Process payments and manage subscriptions
  • Enable content sharing features
  • Provide customer support and respond to inquiries
  • Send important service updates and account-related notifications
  • Send marketing communications (with your consent)
  • Ensure platform security and prevent abuse
  • Detect and prevent fraud, spam, and malicious activity
  • Enforce our Terms of Service and community guidelines
  • Comply with legal obligations and regulatory requirements
  • Protect our rights and the rights of other users

Use of Anonymized Data

Once data has been anonymized such that it can no longer be used to identify any individual, we may use, process, share, publish, commercialize, and retain such Anonymized Data for any purpose and without restriction. This includes but is not limited to:

  • Improving our AI models, algorithms, and response quality
  • Analyzing usage patterns to enhance user experience
  • Developing new features, products, and services
  • Conducting research, analytics, and benchmarking
  • Publishing aggregate statistics and industry reports
  • Marketing, business intelligence, and commercial purposes
  • Sharing with third parties for any lawful purpose
  • Training machine learning models

You acknowledge and agree that Anonymized Data is no longer personal data, and we have no obligations to you with respect to such data.

5. Sharing and Disclosure of PII

WE DO NOT SELL YOUR PERSONALLY IDENTIFIABLE INFORMATION WITHOUT YOUR EXPLICIT, AFFIRMATIVE OPT-IN. The only circumstance in which we exchange PII for compensation is the opt-in Educational Discovery program described below, and it only ever includes information you choose to submit for that purpose. We may share PII only in the following limited circumstances:

With Your Explicit Consent

  • When you share notes or content with other users
  • When you explicitly authorize sharing through our platform
  • When you opt-in to specific features that require data sharing

Educational Discovery (Opt-In Only, Adults 18+)

Fennie can help educational institutions discover you. "Educational institutions" means universities and colleges as well as trade schools, vocational and apprenticeship programs, certification providers, and other career-training organizations. In places where this feature is offered — such as the signup prompt on our study guide, university, and career pages, a request-information form, or an optional checkbox during account sign-up — you can opt in to Educational Discovery. If you do, we will share the contact and interest information you provided — such as your email address, name and phone number (if provided), intended area of study or career path, and expected enrollment timeframe — together with interest topics drawn from the study guide and program pages you visit on Fennie after opting in, with the institution you selected and/or other institutions whose programs match your interests, so their admissions or enrollment teams can reach out to you.

  • We may be paid for these introductions. Educational institutions or their authorized admissions, enrollment, and marketing partners may compensate us when we connect them with you. Under some U.S. state privacy laws (including the California Consumer Privacy Act), this constitutes a "sale" or "sharing" of personal information.
  • Free Premium incentive (Notice of Financial Incentive). Opting in earns free Fennie Premium when you create an account with the same email address: one month for opting in, or four months (a semester) if you also complete the optional interest profile. This is a financial incentive program under the California Consumer Privacy Act and similar laws. We offer it because opted-in introductions generate referral revenue for us; we estimate in good faith that the value of your opt-in to us is reasonably comparable to the retail value of the free period offered (approximately $5–$20, based on our subscription pricing of $4.99/month and typical education referral fees). Limit one redemption per person and email address. You may withdraw your opt-in at any time; if you do, any remaining free Premium from this program ends going forward, you keep whatever free time you have already used, and you will never be charged for it.
  • It is strictly opt-in. Consent is collected through your affirmative action: submitting a signup form whose sole, clearly stated purpose is Educational Discovery, or ticking a clearly labeled, default-unticked checkbox where the feature is offered alongside another purpose. Opting in is never a condition of creating an account or using any Fennie feature. Before you opt in, browsing shares nothing: simply visiting a university page, career page, or study guide is never collected for this program, and dismissing the signup prompt stores nothing. Page-topic interest signals are collected only after you opt in, and stop if you withdraw.
  • Only discovery data is shared. We share what you submit on the signup, plus the topics of Fennie study guide and program pages you visit after opting in (as interest categories, never as raw browsing logs). Your notes, chat conversations, study materials, grades, quiz performance, and other platform data are never included in Educational Discovery.
  • You can withdraw at any time. You may opt out of future discovery sharing, and ask us to instruct participating institutions to stop contacting you, by emailing support@fennie.ai or using the "Do Not Sell or Share My Personal Information" link on our site. Withdrawal does not affect information already transmitted at your request, but you may contact an institution directly to exercise your rights with them.
  • Adults only. Educational Discovery is limited to individuals 18 and older. We ask your age when you sign up; if you tell us you are under 18, we decline the signup and do not store or share anything you entered. We never knowingly sell or share the personal information of anyone under 18.

Essential Service Providers

  • Cloud hosting providers (Vercel, Supabase) - for service operation
  • AI service providers (OpenAI) - for AI functionality
  • Payment processors (Stripe) - for subscription management
  • Authentication providers - for secure login

All service providers who receive PII are bound by strict confidentiality agreements and may only use your PII to provide services to us.

Legal Requirements

  • To comply with applicable laws, regulations, or legal processes
  • To protect our rights, property, or safety, or that of our users
  • To prevent fraud, abuse, or security threats
  • To enforce our Terms of Service and community guidelines
  • In connection with a business transfer (with appropriate safeguards for PII)

Anonymized Data

Anonymized Data is not PII and may be shared, sold, licensed, published, or otherwise disclosed to any third party for any lawful purpose, without restriction and without notice or compensation to you. The restrictions in this section apply only to PII, not to Anonymized Data.

6. Data Security

We implement comprehensive technical and organizational measures to protect your PII:

  • End-to-end encryption for data in transit and at rest
  • Regular security assessments and penetration testing
  • Multi-factor authentication and access controls
  • Secure cloud infrastructure with industry-standard security
  • Regular backups and disaster recovery procedures
  • Employee training on data protection and privacy
  • Incident response and breach notification procedures
  • Regular security audits and compliance monitoring

7. Data Retention

We retain your PII only as long as necessary for the purposes outlined in this policy:

  • Account data: Until account deletion or 2 years of inactivity
  • Content data: Until you delete it or close your account
  • Usage logs: Up to 3 years for security and service improvement
  • Payment data: As required by financial regulations (typically 7 years)
  • Legal compliance data: As required by applicable laws
  • Banned user data: Indefinitely to prevent re-registration and abuse
  • Anonymized Data: Retained indefinitely with no restrictions, as it is no longer considered personal data

Upon account deletion, we will delete or anonymize your PII within 30 days, except where retention is required by law. Any data that has already been anonymized prior to account deletion will be retained as Anonymized Data.

8. Your Rights and Choices

You have the following rights regarding your Personally Identifiable Information:

  • Access: Request a copy of your PII in a portable format
  • Correction: Update or correct inaccurate PII
  • Deletion: Request deletion of your PII (subject to legal requirements)
  • Portability: Export your PII in a machine-readable format
  • Restriction: Limit how we process your PII in certain circumstances
  • Objection: Object to certain types of PII processing
  • Withdrawal of Consent: Withdraw consent for optional PII processing
  • Opt-out: Opt out of marketing communications

These rights apply to PII only. Because Anonymized Data cannot be linked back to you, we are unable to action access, correction, or deletion requests for Anonymized Data.

U.S. State Privacy Rights (California and Similar Laws)

If you are a resident of California or another U.S. state with a comprehensive privacy law, you have additional rights with respect to "sales" and "sharing" of personal information. The only sale or sharing we engage in is the opt-in Educational Discovery program described in Section 5. In connection with it:

  • Right to opt out of sale or sharing: You may opt out at any time via the "Do Not Sell or Share My Personal Information" link on our site or by emailing support@fennie.ai. Because Educational Discovery only ever happens when you affirmatively opt in, declining to opt in also means your information is never sold or shared.
  • Global Privacy Control: We honor opt-out preference signals such as Global Privacy Control (GPC) as an opt-out of sale and sharing for the browser or device sending the signal, as required by applicable law.
  • Minors: We do not sell or share the personal information of anyone under 18. Educational Discovery — the only sale or sharing we engage in — is limited to self-declared adults 18 and older.
  • Non-discrimination: We will not deny you services, charge you different prices, or provide a different quality of service because you exercised any of these rights.
  • Categories involved: The only categories of personal information sold or shared are identifiers and contact details you submit when opting in (name, email, phone if provided), the academic-interest details you choose to include, and interest topics drawn from the Fennie study guide and program pages you view after opting in. The only categories of recipients are educational institutions — universities, colleges, trade schools, and career-training providers — you selected or, only if you separately opt in to broader discovery, whose programs match your stated interests, along with their authorized admissions and enrollment representatives.

9. Account Termination and Bans

We reserve the right to terminate or suspend accounts for violations of our Terms of Service:

  • Accounts may be banned for abuse, fraud, or Terms of Service violations
  • Banned users' data may be retained to prevent re-registration
  • We may share information about banned users with other services to prevent abuse
  • Appeals for account bans should be submitted to support@fennie.ai

10. Cookies and Tracking

We use cookies and similar technologies for:

  • Maintaining your session and preferences
  • Analyzing usage patterns and improving our service
  • Providing security features and fraud prevention
  • Enabling third-party integrations and functionality
  • Personalizing your experience and recommendations

You can control cookies through your browser settings, but this may affect service functionality. We do not use tracking cookies for advertising purposes.

11. Children's Privacy

Our service is not intended for children under 13. We do not knowingly collect personal information from children under 13. If we become aware of such collection, we will delete the information immediately. Users between 13-18 should have parental consent to use our service.

We do not knowingly sell or share the personal information of anyone under 18. The Educational Discovery program described in Section 5 is limited to self-declared adults 18 and older; signups declaring an age under 18 are declined without storing any of the submitted information.

12. International Data Transfers

Your information may be transferred to and processed in countries other than your own. We ensure appropriate safeguards are in place to protect your data during such transfers, including standard contractual clauses and adequacy decisions where applicable.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new policy on this page, updating the "Last updated" date, and sending email notifications for significant changes. Your continued use of the service after changes constitutes acceptance of the updated policy.

If a change would permit a materially new use or disclosure of PII collected before the change, we will apply the new practice only to information collected after the change takes effect, or obtain your affirmative consent before applying it to previously collected information. The Educational Discovery program operates on this basis: it applies only to information you submit after affirmatively opting in.
